Myths and Misconceptions About Elder Law

September 28, 2018 by Audra Bailey Wilcox Leave a Comment

This is an article from Zimmer Law Firm (https://zimmerlawfirm.com/) in Cincinnati, Ohio, that we thought others may find helpful.

Elder law attorneys can offer you help with a wide variety of different issues that should be addressed in order to begin planning for your future. Elder law attorneys can advise you on setting goals, making effective use of legal tools to carry out your plans, and taking steps to protect yourself and your loved ones. People of all ages can benefit from the advice of an elder law attorney. Unfortunately, most people aren’t aware of how valuable they can be when utilized properly.

In fact, there are lots of myths and misconceptions about elder law that prevent people from getting the legal assistance needed to achieve the level of security they want for themselves and their families. To make sure you do not miss out on services that could benefit you and the people you care about, contact a local elder law attorney to find out what he or she can do for you. Read on to find out the truth about common myths and misconceptions about elder law.

Myth: Elder Law Attorneys Only Help Seniors

Because of the name, elder law, many people think that only seniors need help from elder law attorneys. This is not the case. People of all ages could face issues that elder law attorneys offer help with. For example, young people who are newly married and starting families should make plans to provide for their spouses and children in case something happens to them. An elder law attorney can aid in addressing these issues. Young people should also make plans for retirement early in life, including setting up IRAs, so they can save enough to have financial security as a senior. By reaching out to an attorney when you are still young, it will be easier to save enough to accomplish your financial goals.

Myth: You Can Wait to Talk with an Elder Law Attorney

Another common misconception is that you can wait until you get older and sicker to address some of the key issues elder law attorneys help with. Unfortunately, you never know when you will become sick, get hurt, or pass away — and if you don’t have plans in place before this happens, it could be too late for you to use tools to protect yourself and your family. There are many steps that you should take while you’re still of sound mind, including making an incapacity plan in case of a medical emergency. You also want to make a Medicaid plan long before you need medical care in a nursing home, because Medicaid may be the only source of payment for nursing home services and you may be ineligible to get covered by means-tested Medicaid if you haven’t made advanced plans.

Myth: Elder Law Attorneys Only Help with Wills

Many people wait to talk with elder law attorneys because they think that lawyers in this field only help with creating a will or creating an estate plan. While elder law attorneys can help with the estate planning process, they also do much more. Elder law attorneys can help with business succession plans, asset protection, and retirement planning. Because you want to make plans for your company and your financial security when you are young, it makes sense to reach out to an elder law attorney early on to find out what types of services an attorney can offer to help you prepare for your future.

Getting Help from Elder Law Attorneys

Now you know what elder law attorneys really do. There are numerous services an elder law attorney can provide; some that you may not have even known you needed. Remember, it’s best to start creating your estate plan sooner than later in order to get the appropriate tools set up and plans in place. Otherwise, it could become too late to take advantage of the resources that could offer you and your family important protections in the future.
